Terms of Use

Welcome to HabitGenius. These Terms of Use ("Terms") govern your access to and use of the HabitGenius mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. Please read them carefully.

1. Acceptance of Terms

By downloading, installing, accessing, or using the HabitGenius mobile application (the "App"), you ("User," "you," or "your") enter into a legally binding agreement with HabitGenius ("we," "us," or "our") and agree to comply with these Terms of Use. If you do not agree to these Terms, you are not authorized to use the App.

These Terms apply to all users of the App, regardless of whether you use the free version or subscribe to premium features.

2. Eligibility

The App is intended for users aged 13 years and older. By using the App, you represent and warrant that you are at least 13 years old. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that you have obtained parental or guardian permission to use the App.

Note: The App does not include age verification technology. We rely on users and parents/guardians to ensure compliance with age requirements.

3. License Grant

Subject to your compliance with these Terms, HabitGenius grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable, worldwide license to:

• Download, install, and use the App on your personal mobile device(s)
• Access and use the App's features and functionality for personal, non-commercial purposes only

3.1 License Restrictions

You may NOT:

• Copy, modify, adapt, translate, or create derivative works of the App
• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App
• Rent, lease, lend, sell, sublicense, assign, distribute, publish, transfer, or otherwise make the App available to third parties
• Remove, alter, or obscure any proprietary notices (including copyright and trademark notices) on the App
• Use the App for any commercial purpose or for the benefit of any third party
• Use the App in any manner that could damage, disable, overburden, or impair our servers or networks
• Attempt to gain unauthorized access to any portion of the App or computer systems or networks
• Use any robot, spider, scraper, or other automated means to access the App

3.2 Updates and Modifications

We may update, modify, or discontinue the App or any features at any time without prior notice. You agree that we shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.

4. Acceptable Use and Prohibited Conduct

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Use the App in any way that violates any applicable federal, state, local, or international law or regulation
• Exploit, harm, or attempt to exploit or harm minors in any way
• Transmit, or procure the sending of, any advertising or promotional material without our prior written consent
• Impersonate or attempt to impersonate HabitGenius, a HabitGenius employee, or any other person or entity
• Engage in any conduct that restricts or inhibits anyone's use or enjoyment of the App
• Use the App in any manner that could disable, overburden, damage, or impair the App or interfere with any other party's use of the App
• Introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful
• Attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the App, the server on which the App is stored, or any server, computer, or database connected to the App
• Attack the App via a denial-of-service attack or a distributed denial-of-service attack

5. Subscriptions and In-App Purchases

HabitGenius offers a free version with basic features and premium subscriptions that unlock additional features.

5.1 Subscription Plans

Premium subscriptions are offered on the following billing cycles:

• Monthly subscription: Billed every month (approximately $1.50/month, may vary by region)
• Annual subscription: Billed every year (approximately $11.99/year, may vary by region)
• Lifetime subscription: One-time payment for permanent access (approximately $29.99, may vary by region)

Subscription pricing is displayed in the App and may vary by region, currency, and promotional offers. Prices are subject to change with reasonable notice.

5.2 Premium Features

Premium subscriptions unlock the following features:

• Auto Cloud Backups (Google Drive or iCloud)
• Track unlimited habits and periodic tasks
• Habits and tasks with sub-items/checklists
• Habits with timer and stopwatch
• Advanced repeat patterns for tasks and habits
• Statistics for moods (Week, Month, Year, All time)
• Statistics for journals
• Statistics for all habits
• Focus Timer statistics (Month, Year, All Time)
• Custom timer durations and quick adjust
• Tasks overview
• In-depth income and expense statistics
• Unlimited accounts and budgets
• Unlimited recurring transactions
• Widgets

5.3 Payment Processing

All payments are processed through the Apple App Store (for iOS) or Google Play Store (for Android). By subscribing, you agree to the applicable store's terms of service:

Payment will be charged to your Apple ID or Google Play account at confirmation of purchase. We do not store your payment information.

5.4 Automatic Renewal

Monthly and Annual subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Lifetime subscriptions do not renew and provide permanent access to premium features.

5.5 Managing and Canceling Subscriptions

You can manage or cancel your subscription at any time through your device settings:

• iOS: Settings → [Your Name] → Subscriptions → HabitGenius → Cancel Subscription
• Android: Google Play Store → Menu → Subscriptions → HabitGenius → Cancel Subscription

Canceling your subscription will turn off auto-renewal, but you will retain access to premium features until the end of your current billing period.

5.6 Free Trials

We may offer free trials for premium subscriptions from time to time (typically 3 or 7 days for iOS users). If you subscribe through a free trial:

• You will have access to premium features for the trial period
• You will be charged the subscription price at the end of the trial period unless you cancel before the trial expires
• You can cancel the trial at any time through your device settings to avoid being charged
• Free trials are limited to one per user and cannot be combined with other promotional offers

5.7 Refunds

All sales are final. We do not offer refunds for any unused portion of a subscription term. However, you may request a refund directly from Apple or Google:

Refund decisions are made solely by Apple or Google according to their policies. HabitGenius does not control or influence refund decisions.

5.8 Price Changes

We reserve the right to change subscription prices at any time. If we increase the price of your subscription:

• You will receive advance notice (typically 30 days) via in-app notification
• The new price will apply to your next billing cycle after the notice period
• You may cancel your subscription before the new price takes effect to avoid the increase

6. Intellectual Property Rights

6.1 App Ownership

The App and its entire contents, features, and functionality (including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement) are owned by HabitGenius, its licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

6.2 Trademarks

The HabitGenius name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of HabitGenius or its affiliates or licensors. You may not use such marks without our prior written permission.

7. User Content and Data Ownership

7.1 Your Content

You retain all ownership rights to any content you create, input, or store within the App, including but not limited to:

• Habit tracking data (habit names, completion records, streaks, goals, notes, sub-items/checklists)
• Task and to-do lists (descriptions, due dates, recurring tasks)
• Mood tracking data (mood levels, tags, notes, patterns)
• Financial data (income, expenses, budgets, account balances, transaction details, recurring transactions)
• Journal entries (text, photos, attachments, tags)
• Focus timer data (Pomodoro sessions, durations, notes, productivity statistics)
• Custom categories, tags, and settings

You own your data. We do not claim any ownership rights over your content.

7.2 Limited License from You

By using the App, you grant HabitGenius a limited, non-exclusive, royalty-free, worldwide license to:

• Store your content locally on your device using MMKV storage and local file system
• Display your content within the App for your personal use
• Sync your content to your chosen cloud storage service (iCloud for iOS or Google Drive for Android/iOS) only if you subscribe to Premium and enable cloud backup
• Process your content to provide app features (statistics, charts, local notifications, widgets, CSV exports)

Important: This license is solely for the purpose of operating and providing the App's functionality. We do not access, view, share, or use your content for any other purpose.

7.3 Cloud Backup (Optional, Premium Feature)

Cloud backup is optional, disabled by default, and available only to Premium subscribers. If you subscribe to Premium and enable cloud backup:

• iOS: Your data will be backed up to your personal iCloud account using CloudKit
• Android & iOS: Your data will be backed up to your personal Google Drive account (encrypted with CryptoJS before upload)

You control when backups occur and can disable cloud sync at any time in Settings → Backup. HabitGenius does not have access to your iCloud or Google Drive accounts. Cloud backups are subject to Apple's and Google's respective terms of service and privacy policies.

7.4 Data Export

You can export your data in the following ways:

• CSV Export: Export expense transaction data to CSV format (Settings → Backup & Export)
• Local Backup: Create encrypted .hg backup files containing all app data except journal media files (available to both Free and Premium users)

Backup files are stored in Downloads (Android) or On My iPhone/HabitGenius (iOS) and can be manually exported and imported for device transfers.

7.5 Data Deletion

You can delete your data at any time:

• Delete individual habits, moods, expenses, journal entries, focus sessions, tasks, categories, budgets, and accounts by long-pressing or swiping on the item
• Uninstalling the App will permanently delete all locally stored data from your device

Note: The App does not include a "Delete All Data" feature. To remove all data, you must uninstall the App. Cloud backups in iCloud or Google Drive must be deleted separately from your cloud storage settings.

8. Third-Party Services and Integrations

The App integrates with the following third-party services to provide functionality:

• RevenueCat: Subscription management and in-app purchase processing
• Firebase Analytics: Anonymous usage analytics to improve the App (active in production builds only)
• Sentry: Error tracking and crash reporting for debugging
• Apple iCloud (CloudKit): Optional cloud backup for iOS users (Premium feature)
• Google Drive: Optional cloud backup for Android and iOS users (Premium feature)

These third-party services have their own terms of service and privacy policies, which govern your use of those services. We are not responsible for the actions, content, or policies of third-party services.

9. Privacy

Your use of the App is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, store, and protect your information.

Key Privacy Points:

• All your personal data is stored locally on your device by default
• We do not access, view, or share your habits, moods, expenses, journal entries, or focus data
• Cloud backup is optional, Premium-only, and controlled by you
• We collect anonymous analytics via Firebase and Sentry to improve the App
• We do not sell your data to third parties
• We do not use your data for advertising

10. Disclaimers and Warranties

10.1 "AS IS" and "AS AVAILABLE"

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.

10.2 No Warranty of Accuracy or Reliability

HabitGenius does not warrant that:

• The App will function uninterrupted, securely, or be available at any particular time or location
• Any errors or defects will be corrected
• The App is free of viruses or other harmful components
• The results of using the App will meet your requirements or expectations
• The accuracy, reliability, or completeness of any content, statistics, or analytics provided by the App

10.3 Not Professional Advice

Important: The App is designed for general informational and productivity purposes only. It is NOT a substitute for professional advice, diagnosis, or treatment.

• Not Medical or Mental Health Advice: The mood tracking features are for personal self-reflection only and do not constitute medical, psychological, or mental health advice. If you are experiencing mental health issues, please consult a licensed healthcare professional.
• Not Financial Advice: The expense tracking and budgeting features are for personal financial management only and do not constitute professional financial, investment, tax, or accounting advice. Please consult a certified financial advisor for financial planning.
• Not Health or Fitness Advice: Habit tracking and goal-setting features are for personal motivation only and do not constitute health, fitness, nutrition, or medical advice.

10.4 Third-Party Content

Any content, suggestions, or recommendations provided by the App are for informational purposes only. We do not endorse, verify, or guarantee the accuracy of any such content.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HABITGENIUS, ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS, OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE APP, INCLUDING:

• Direct, indirect, incidental, special, consequential, or punitive damages
• Personal injury, pain and suffering, emotional distress, loss of revenue, loss of profits, loss of business or anticipated savings, loss of use, loss of goodwill, loss of data
• Damages arising from reliance on any information provided by the App
• Damages caused by errors, omissions, interruptions, deletion of files or data, defects, viruses, delays in operation or transmission, or any failure of performance

THE FOREGOING DOES NOT AFFECT ANY LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

Maximum Liability: In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law. In no event shall our total liability to you for all damages exceed the amount you paid to us in the twelve (12) months prior to the action giving rise to liability, or $100 USD, whichever is greater.

12. Indemnification

You agree to defend, indemnify, and hold harmless HabitGenius, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to:

• Your violation of these Terms
• Your use or misuse of the App
• Your violation of any law, regulation, or rights of a third party
• Any content you create, input, or transmit through the App

13. Changes to Terms

We reserve the right to modify, update, or replace these Terms at any time at our sole discretion. If we make material changes to these Terms:

• We will notify you by updating the "Last updated" date at the top of these Terms
• We may notify you via in-app notification or a notice on our website
• Material changes will take effect 30 days after notification, unless otherwise required by law

Your continued use of the App after any changes to these Terms constitutes your acceptance of the new Terms. If you do not agree to the modified Terms, you must stop using the App.

We encourage you to review these Terms periodically to stay informed of any updates.

14. Termination

14.1 Termination by You

You may stop using the App at any time by:

• Uninstalling the App from your device
• Canceling your subscription (if applicable) through your device settings
• Deleting individual data items within the App

14.2 Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including but not limited to:

• Breach of these Terms
• Violation of applicable laws or regulations
• Fraudulent, abusive, or illegal activity
• Requests by law enforcement or other government agencies
• Discontinuation or material modification of the App

14.3 Effect of Termination

Upon termination:

• Your right to use the App will immediately cease
• Your subscription (if active) will be canceled, and you will not receive a refund for any unused portion
• All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability

15. Dispute Resolution and Arbitration

15.1 Informal Dispute Resolution

Before filing a claim, you agree to try to resolve the dispute informally by contacting us at habitgenius1997@gmail.com. We will attempt to resolve the dispute informally within 60 days. If we cannot resolve the dispute within 60 days, you or we may initiate arbitration proceedings.

15.2 Binding Arbitration

If the informal dispute resolution process does not resolve the dispute, you and HabitGenius agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be settled by binding arbitration, rather than in court, except that:

• You may assert claims in small claims court if your claims qualify
• You or we may seek equitable relief in court for infringement or misuse of intellectual property rights

15.3 Class Action Waiver

YOU AND HABITGENIUS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.

15.4 Exceptions

Notwithstanding the above, disputes may be resolved in court if:

• Arbitration is prohibited by the laws of your jurisdiction
• The dispute qualifies for small claims court
• The dispute involves intellectual property infringement

16. Governing Law and Jurisdiction

These Terms and any dispute arising out of or related to these Terms or the App shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

For disputes that are not subject to arbitration (as described above), you agree to submit to the personal and exclusive jurisdiction of the courts located in Gujarat, India.

International Users: If you access the App from outside India, you are responsible for compliance with local laws in your jurisdiction.

17. Export Control and Sanctions

The App may be subject to export control and economic sanctions laws of India, the United States, the European Union, and other jurisdictions. You represent and warrant that:

• You are not located in a country that is subject to a comprehensive U.S., EU, or Indian government embargo
• You are not listed on any government list of prohibited or restricted parties
• You will not use the App in violation of any export control or sanctions laws

18. App Store and Platform Terms

18.1 Apple App Store

If you download the App from the Apple App Store, you acknowledge and agree that:

• These Terms are between you and HabitGenius, not Apple, and Apple is not responsible for the App or its content
• Apple has no obligation to furnish maintenance and support services with respect to the App
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever
• Apple is not responsible for addressing any claims you or any third party may have relating to the App
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you

18.2 Google Play Store

If you download the App from the Google Play Store, you acknowledge and agree that:

• These Terms are between you and HabitGenius, not Google, and Google is not responsible for the App or its content
• Google has no obligation or liability to you with respect to the App
• Your use of the App must comply with Google Play's Terms of Service

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and HabitGenius regarding your use of the App and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the App.

20. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable under applicable law, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its intent. If such modification is not possible, the provision shall be severed from these Terms, and the remaining provisions shall remain in full force and effect.

21. Waiver

No waiver by HabitGenius of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure by HabitGenius to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

22. Force Majeure

HabitGenius shall not be liable for any failure or delay in performance of its obligations under these Terms due to causes beyond its reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials.

23. Assignment

You may not assign, transfer, or delegate these Terms or your rights and obligations hereunder without our prior written consent. We may freely assign, transfer, or delegate these Terms and our rights and obligations hereunder without restriction. Any attempted assignment, transfer, or delegation in violation of this section shall be void.
